These Terms and Conditions ("Terms") govern your use of the Shivira Homes website located at shivirahomes.com ("Website") and all related services provided by Shivira Homes, a real estate development company registered and operating under the laws of Andhra Pradesh, India ("Company", "we", "us", or "our").

By accessing or using this Website, requesting a site visit, submitting a booking form, or engaging in any property transaction with us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.

• These Terms apply to all visitors, users, prospective buyers, and registered buyers.
• We reserve the right to update these Terms at any time. Continued use of the Website after updates constitutes acceptance of the revised Terms.

3 Property Transactions

All property purchases through Shivira Homes are subject to the following conditions:

• Every plot sale is governed by a separate Sale Agreement and Sale Deed executed at the time of registration, which shall constitute the final and binding agreement between the parties.
• All projects are government-approved as stated. Buyers are encouraged to independently verify all approvals with the relevant government authorities before purchase.
• The Company provides all available property documents — including title deed, Encumbrance Certificate (EC), government approval, layout plan, and bank pre-approval letters — to buyers prior to payment. Buyers are advised to have these documents reviewed by a licensed advocate or Chartered Accountant before proceeding.
• Plot sizes, dimensions, and boundaries are as specified in the approved layout plan. Minor variations may occur and shall not constitute grounds for cancellation unless specifically agreed in writing.
• Shivira Homes is not responsible for delays in government registration processes that are outside our control.
• RERA compliance: Buyers should confirm current RERA registration status of each project at the time of purchase. All applicable RERA disclosures will be provided upon request.

4 Pricing and Payments

All prices displayed on this Website are in Indian Rupees (INR) unless otherwise stated.

• Pre-launch pricing is available for a limited period only and will not be reinstated once the pre-launch period closes.
• Quoted prices are exclusive of government registration charges, stamp duty, GST (where applicable), and any other statutory charges payable to government authorities.
• The Company does not charge any undisclosed or hidden fees. All costs will be communicated clearly in writing before any payment is made.
• All payments must be made through legal banking channels — NEFT, RTGS, or account-payee cheque. Cash payments exceeding limits prescribed under the Income Tax Act, 1961 are not accepted.
• NRI buyers must make payments from NRE or NRO accounts in compliance with FEMA regulations.

5 Bookings, Cancellations, and Refunds

The following policy applies to all booking amounts and advance payments:

• A booking amount (as specified in the Sale Agreement) is required to reserve a specific plot. This amount will be adjusted against the total sale consideration at registration.
• Cancellation requests must be submitted in writing to [email protected].
• Refund eligibility and the quantum of deductions for cancellation (if any) shall be as specified in the individual Sale Agreement signed by both parties.
• Where cancellation is caused by the Company's inability to deliver the agreed plot or documentation, a full refund of the booking amount will be processed within 30 working days.
• Site visit bookings are free of charge and carry no financial obligation. Non-attendance of a booked site visit does not attract any penalty.

6 Documentation and Due Diligence

Shivira Homes is committed to full documentation transparency. However:

• Buyers are strongly advised to conduct independent legal due diligence through a licensed advocate before executing any Sale Agreement or Sale Deed.
• The Company provides documents in good faith based on information available from the relevant authorities. We are not liable for errors or delays caused by government records or sub-registrar databases.
• Buyers are responsible for verifying the physical boundaries of the plot at the time of site visit and before registration.
• All documents provided by the Company are for the buyer's review only and shall not be reproduced, shared, or used for any purpose other than the buyer's own due diligence without prior written consent.

7 Investment Returns Disclaimer

The ROI Calculator and investment return projections provided on this Website are for informational purposes only and are based on historical price data from the Bellary Highway corridor, Anantapur district. These projections:

• Are estimates only and do not constitute a guarantee, promise, or representation of future returns.
• Are subject to market conditions, government policy, infrastructure development, and other factors beyond the Company's control.
• Should not be relied upon as financial advice. Buyers are advised to consult a SEBI-registered investment adviser or Chartered Accountant before making investment decisions.

11 Governing Law and Dispute Resolution

These Terms and all transactions entered into with Shivira Homes are governed by the laws of the State of Andhra Pradesh and the laws of India, including but not limited to:

• The Indian Contract Act, 1872
• The Transfer of Property Act, 1882
• The Real Estate (Regulation and Development) Act, 2016 (RERA)
• The Foreign Exchange Management Act, 1999 (FEMA) — for NRI transactions
• The Information Technology Act, 2000 — for digital communications

All disputes, claims, or controversies arising from or related to these Terms or property transactions shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts at Anantapur, Andhra Pradesh.
